Terms of Service

1. Agreement to Terms

By accessing or using VATWatch ("the Service"), operated by FS-Dev | A Firestorm Company, Cleveland, Texas, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

VATWatch is an alerting service for the VATSIM flight simulation network. The Service monitors VATSIM ATC (Air Traffic Control) data and delivers notifications when controllers come online along your flight route. VATWatch is not affiliated with or endorsed by VATSIM.

3. Subscription Plans & Billing

VATWatch offers three tiers:

  • Free — No charge, limited to one region and basic alert history.
  • Pro — $4.99/month or $49.99/year. Route-aware alerts, three regions, full alert history, and push notifications.
  • Commander — $9.99/month or $99.99/year. Global coverage, cross-region route watch, Trip Switch, and priority support.

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize FS-Dev | A Firestorm Company to charge your payment method at the applicable rate until you cancel.

4. Cancellation & Refund Policy

You may cancel your subscription at any time from your account settings or through the Stripe customer portal.

  • Monthly plans: When you cancel a monthly subscription, you will retain access to paid features through the end of your current billing period. No further charges will be made. Prorated refunds are not issued for partial months already paid, but you will not be billed for the next period.
  • Annual plans: Annual subscriptions are non-refundable. When you cancel an annual plan, you will retain access to paid features through the end of the prepaid annual period. No partial or prorated refunds will be issued.

5. Acceptable Use

VATWatch is designed exclusively for use with the VATSIM flight simulation network. You agree that:

  • You will use the Service only for VATSIM simulation purposes.
  • You will not use VATWatch data for real-world commercial aviation, air traffic control, or flight operations of any kind.
  • You will not attempt to scrape, reverse-engineer, or overload the Service.
  • You will not share your account credentials or allow others to access the Service through your account.
  • You will comply with all applicable VATSIM policies and codes of conduct.

6. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable. You may delete your account at any time through the account settings page. Upon termination, your right to use the Service ceases immediately. If you have an active paid subscription, cancellation and refund terms in Section 4 apply.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FS-Dev | A Firestorm Company does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • ATC alerts will be delivered for every controller session or delivered within any specific timeframe.
  • The data provided is accurate, complete, or current. VATSIM data is sourced from third-party feeds and may contain errors or delays.

VATWatch is a hobby and simulation tool. It must never be used for real-world aviation decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRESTORM TRAINING & CONSULTING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
